The general terms and conditions apply to the realisation of the contract, the duties of Seasons Tea GmbH and the development of the contracts entered into by the user and Seasons Tea GmbH.

Purpose of General Terms and Conditions
The purpose of the general terms and conditions is to provide a legal basis for contractual conditions of all contracts between Seasons Tea GmbH (supplier) and the online shopper (user), which are entered into through the online shop. Those general terms and conditions, which exist at the time of the conclusion of the contract, apply.
1. [ Creation of contract ]
Offers in the online shop are unbinding. By clicking on the "order" button, the user is making a binding declaration to the supplier that they intend to buy the contents of the shopping basket. The contract will come into existence when the supplier sends an order confirmation to the user. The order confirmation will immediately be sent to the user once they have clicked on the "order" button, but no later than 2 calendar days afterwards. If the order has not arrived after the two-day period has ended, the offer will be considered to be rejected.
2. [ Information duties ]
2.1. The user is required to give true information when placing the order. If the customer’s data changes, in particular their name, address and email address, the user is required to immediately inform the supplier via email at: info@seasonstea.com or, in the case of registered customers (client account) by changing the information in the customer area of the online shop.
2.2. If the user fails to give this information or gives untrue information from the start, in particular a false email address, the supplier, insofar as a contract has been entered into, is entitled to withdraw from the contract. The withdrawal will be made in writing. Sending an email also protects the written notification.
2.3. The supplier will send the customer an email containing the customer’s information immediately after receiving the order but no later than two days to the email address provided by the user when placing the order.
2.4. The customer must ensure that the email address provided be accessible from the time it is provided and that the receipt of emails will not be rendered impossible due to forwarding, suspension or overflow of the email account.
2.5. Faulty information will be suspected if an email sent to the user is returned three times in a row or if the delivery cannot be carried out due to an incorrect address.
3. [ Prices ]
All prices are gross prices in EURO, including all relevant sales tax. The prices at the time of the order are applicable. In the case of a possible rise in sales tax the prices will be increased according to the tax amount.
4. [ Payment ]
4.1. The payment price is due with immediate effect unless otherwise agreed.
4.2. The customer must pay the purchase price only by means of a bank transfer, including the order number and order date to the following account of Seasons Tea GmbH:

4.3. The customer will automatically be in arrears if the payment is not made within 30 days of receipt of the invoice. In the case of arrears, the legal interest on late payments will apply.
4.4. The customer will only have a right to offset if their counterclaims are legally established or if these are recognised by the supplier.
4.5. The customer shall only be entitled to withhold payment if their counterclaim arises from the same contractual relationship.
5. [ Delivery ]
5.1. The delivery will take place, as long as the goods are available in storage, only after the full purchase price is received in the Seasons Tea GmbH account given in 4.2.
5.2. Delivery can be made in the following countries:
o Germany

o Denmark (no delivery possible to overseas countries outside of Europe and the Faeroe Islands)

5.2. Following the receipt of payment, delivery will take place within 2-3 working days for orders in Germany. Deliveries within Europe (Zones 1-4) will take place within 5 working days after receipt of payment.
5.3. If the ordered goods are temporarily unavailable, the customer will be informed of the expected time of delivery via email.
6. [ Packaging and postage costs ]
6.1. Costs for packaging of the goods are covered by the supplier.
6.2. The supplier will charge a postage fee of 5. - € for the delivery of the goods within Germany. If the value of the total order is over 50. - €, the delivery will be free of charge.
6.3. In the case of delivery abroad in Europe, the following postage fees apply:
o Zone 1: 15. - € (for total orders over 150. - €, the delivery will be free of charge)
o Zone 2: 18. - € (for total orders over 180. - €, the delivery will be free of charge)
o Zone 3: 20. - € (for total orders over 200. - €, the delivery will be free of charge)
o Zone 4: 23. - € (for total orders over 230. - €, the delivery will be free of charge)
7. [ Rights of revocation and return ]
7.1. The customer is entitled to withdraw from the contract in writing (e.g. letter fax, email) or by returning the goods within two weeks (by instruction before conclusion of the contract) or one month (by instruction following conclusion of the contract) without giving reasons. The deadline begins no earlier than on the date the instruction was received. The revocation or returned goods shall be considered timely if dispatched within the defined period. 7.2. In the case of an effective revocation the either party is obliged to return any performance received. If the customer is unable to return the received performance fully or is only able to return it in a damaged condition, they are required to pay compensation when required. This is not applicable for the surrender of goods if the damage to the goods is attributable to testing as it might have been performed at a retail shop. In addition to this, the requirement to pay damages can be avoided if the customer avoids using the goods as an owner and refrains from any action, which may reduce their value.
7.3. When exercising the right of revocation the customer will bear the cost of returning the goods if the order value does not exceed 40. - €, unless the delivered goods are not the same as the goods ordered. The customer is required to return the goods within two weeks after exercising their right of revocation if the right has not already been exercised by returning the goods.
8. [ Guarantee ]
The guarantee is in accordance with legal conditions as unless subsequently otherwise arranged. Should it be established that goods have been damaged during transportation, the customer should immediately report the damage to the delivery service. Other identifiable transportation damage should be made effective by writing to Seasons Tea GmbH no later than 10 days of receiving the goods. Seasons Tea GmbH is not liable for deficiencies, which have resulted from faulty handling or circumstances beyond our control.
9. [ Applicable law, legal venue ]
The laws of the Federal Republic of Germany apply; to the exclusion of the UN Convention on Contracts for the International Sale of Goods (UN CISG). If the customer is a registered trader or a public entity, Berlin is agreed as the place of jurisdiction.
10. [ Data protection ]
In order to process the order and delivery of goods, names, addresses, telephone numbers and email addresses for online orders are required. The customer can access information about their saved data at any time. Seasons Tea GmbH will not pass on customer data to third parties, expect for partner companies, which need the data to carry out the order.
11. [ Validity of the general terms and conditions ]
The general terms and conditions of the company are accepted when an order is placed. Should a condition within the general terms and conditions become void for whatever reason, the remaining conditions will be unaffected. Verbal agreements require written confirmation.
